Terms of Service

The service

TopLoad is an app and website for tracking Pokémon cards, graded slabs and sealed products, with price estimates, profit and loss, and set progress. It is provided by Ahmed Abdalla.

Who can use it

You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you. You are responsible for your account and for keeping your sign-in details safe.

Prices are estimates, not advice

Prices come from third-party sources, mainly TCGplayer market data and recent eBay sales. They can be late, incomplete or wrong, and some are marked as estimated or low confidence. Values in TopLoad are for your information only. They are not an appraisal, an offer, or financial, investment or tax advice, and you should not rely on them to buy, sell, insure or grade anything.

Your content

The collection data you enter stays yours. You give us permission to store and process it so we can run the service for you. You promise that what you add is yours to add and does not break the law or anyone’s rights.

Acceptable use

• Do not break the law, attack or overload the service, or try to access other people’s accounts or data.
• Do not scrape the service, reverse engineer it, or resell its data.
• Do not upload anything harmful or use TopLoad to deceive other collectors.

Third-party content and trademarks

Pokémon and its card names and images are the property of Nintendo, Creatures Inc., GAME FREAK inc. and The Pokémon Company. TCGplayer, eBay, PSA, BGS and CGC are trademarks of their owners. TopLoad is an independent project and is not affiliated with, endorsed by or sponsored by any of them. Card images shown in the app are provided by TCGplayer for identification purposes.

Our property

The TopLoad name, logo, design and software belong to us. You may use the service as intended, but you may not copy it or claim it as your own.

Cost

TopLoad is currently free, with no in-app purchases or subscriptions. If that ever changes we will show the full price before you pay and update these terms. See the Refund Policy.

Availability and changes

We try to keep TopLoad running, but it is provided “as is” and may have errors or downtime. We may change or stop features, and we may update these terms. If you keep using the service after an update, you accept the new terms.

Ending your account

You can delete your account at any time (see Delete your data). We may suspend or end accounts that break these terms or put the service or other people at risk.

No warranty and limits on liability

To the fullest extent the law allows, we give no warranties about the service, including about the accuracy of prices, and we are not liable for indirect or consequential losses, lost profits, or decisions you make using TopLoad. Our total liability for any claim is limited to the greater of the amount you paid us in the past twelve months (currently nothing) and 50 US dollars. Nothing here limits rights you have by law that cannot be limited, such as for fraud or for death or personal injury caused by negligence.

Apple

If you get the app from the Apple App Store, Apple is not a party to these terms, is not responsible for the app or for support, and its standard end-user license terms also apply. Apple and its subsidiaries are third-party beneficiaries of these terms for the app.

Governing law

These terms are governed by the State of New Jersey, USA, without regard to conflict-of-law rules, and subject to any mandatory consumer rights where you live.
